Planning to recruit from the EU in 2021?

 

From 1 January 2021, recruitment is changing for UK companies.
The introduction of Brexit means new conditions for companies and employees.

The new system puts an end to free movement and brings new requirements in terms of employment, salary, language and hiring. Employers will be compulsory to register to become an approved sponsor. They have until the end of the year to complete the process before any hiring outside the UK.

For the company

How to become a sponsor?

First, you need to:
– Verify that the people you hire meet the conditions for working in the United Kingdom
– Verify the eligibility of his company

To register, you will need:

  • Choose the type of skill worker licence
  • Put in place the means to act as a sponsor
  • Apply online and pay fees

Sponsorship allows you to recruit skilled workers from around the world for 4 years.

Intra-company transfers

If you want to transfer a worker from part of your business overseas to work for you in the
UK, he or she can apply for an intra-company transfer. Applicants will need to be existing
workers who are performing functions that meet the skill and salary thresholds.

They will need to:

  • Be sponsored as an intra-company transfer by an approved sponsor
  • Have 12 months of work experience in a company that is linked by ownership to the British company for which they will work
  • Hold a position at the required skill level of RQF 6 or higher (equivalent to diploma level)
  • Be paid at least £41,500 or the going rate

Authorization for employees transferred to the United Kingdom on the intra-company transfer route is temporary. Workers may be posted to the United Kingdom on several occasions, but they may not remain in the United Kingdom for more than five years out of a six-year period.

For the worker

Future workers from the United Kingdom will have to meet certain requirements before they can apply:

  •  Apply for a permit
  • Must speak English at the required level
  • The job offer must come from an approved sponsor.
  • The job offer must match the skill level (RQF 3 (equivalent to Level A)) and salary requirement (£25,600 or the going rate)

If the salary of the job is less than this amount – but not less than £20,480 – the applicant can still apply by trading points on specific characteristics for his or her salary. (Ex: occupation in shortage or a PhD in the field).

If the above conditions are met, the application can be sponsored by your employer and you can start working in the UK.

Exception:
– For Irish citizens
– For employees with a non-sponsored visa (Global Talent)

 

EU citizens already employed before December 31, 2020
The new system will not apply to EU employees already working in the UK.
However, they will have to register for the EU settlement program by June 30, 2021.
